Preamble

These general conditions govern the relationship between seller and buyer hereinafter called "the client" on the website www.valeriebcartier.com, edited by Valérie Belanger Cartier, 11 bis passage de la Visitation 75007 PARIS, hereinafter called "VBC "Siren: 512616442.

www.valeriebcartier.com is an online sales site which presents the collections of the VBC catalog and which offers articles from the catalog:

- either directly for sale on the site

- either in the form of affiliate links with ZAZZLE Redwood City, California, United States. These affiliate links are provided to direct you to a product page from our partner Zazzle, products personalized by VBC. We do not personally manufacture or ship any of our partner's products. The products are produced, distributed and sold directly by our partner. Sales made through the Zazzle site are governed by Zazzle's own terms and conditions. VBC is not responsible for the compliance of products with the promotional images on the Zazzle site.

Article 1: Fields of application and modification of the General Conditions of Sale

Our direct sales are governed by these general conditions with the exception of those made via the Zazzle partner site for which Zazzle's general conditions of sale will apply. The customer expressly declares to accept these general conditions, and waives, as necessary, his own conditions, or any other document from where he comes from.

Article 2: Validation of orders

Any order validated by the customer constitutes an irrevocable acceptance of the sales contract which can only be called into question within the limits provided for in these general conditions of sale under the "right of withdrawal"

VBC confirms the acceptance of its order to the customer at the email address that the latter will have communicated.

VBC reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order

Article 3: Delivery time and shipment of goods

The product is delivered no later than 30 days after receipt of the order to the address mentioned by the customer.

VBC is not liable when the failure to deliver is attributable to the customer or when it is a consequence, either of an unforeseeable and insurmountable fact of a third party to the contract, or of a case of force majeure.

Items are shipped by DHL delivery only.

Article 4: Right of withdrawal

Personalized items:

The exercise of the legal right of withdrawal is excluded for products made according to the consumer's specifications or clearly personalized (Article L221-28 of the Consumer Code).

Non-personalized items:

Any buyer, natural person, who acquires a property that will not be used, primarily, for the exercise of his professional activity, is eligible for the right of withdrawal.

The consumer then has a period of 14 days to exercise his right of withdrawal, without having to justify his decision.

The period of 14 days runs from the receipt of the goods by the consumer or a third party designated by him.

The customer informs VBC of his decision to withdraw by email, before the expiration of the period of 14 days. The customer must return the product within 14 days of his decision to withdraw.

The customer is informed of the possibility of exercising a right of withdrawal, by email, during his order confirmation.

The cost of returning the product or equipment remains the full responsibility of the customer and under his responsibility to our warehouses and this in the event of theft, loss or damage to the returned product.

The choice of the return method and the service provider ensuring this return remains a free choice and under the entire responsibility of the customer.

In general, the product subject to the right of withdrawal must imperatively be suitable for a new remarketing by VBC.

Reimbursement is made by VBC on the total amount paid, including delivery costs within 14 days of the return of the goods sold.

The reimbursement is made using the same means of payment as that used by the customer for the initial transaction.

Article 5: Orders

Any Order can only be made when the customer has registered on the Site. The customer, when logged into his account, can add Services to his virtual basket. He can access the summary of his virtual basket to confirm the Services he wishes to order and place his Order by pressing the “Order” button.

He must then enter his address, the delivery method and a valid payment method in order to finalize the order and effectively form the sales contract between him and VBC.

The recording of an Order on the Site is carried out when the customer accepts the GTC / CGU by checking the box provided for this purpose and validates his Order. This validation constitutes proof of the sales contract. The finalization of the Order implies acceptance of the prices and terms of performance of the services as indicated on the Site.

Once the order has been placed, the customer will receive confirmation by email.

This confirmation will summarize the Order and information relating to the performance of the service (s).

In the event of default of payment, incorrect address of the customer or other problem on the Customer's account, the Company reserves the right to block the order until the problem is resolved. If it is impossible to provide the service, the Customer will be informed by email at the address he has provided to VBC. The cancellation of the order for this service and its refund will be made in this case, the rest of the order remaining firm and final.

VBC may allow the Customer to benefit from price reductions, discounts and rebates according to the number of Services ordered or according to the regularity of Orders, according to the conditions set by it.

Article 6: Liability exemption

VBC can in no way be held responsible for the unavailability, whether temporary or permanent, of the Website and, although it implements all means to permanently ensure the service, it may be that -it be interrupted at any time. In addition, VBC

reserves the right, by a voluntary act, to make the Site unavailable in order to carry out any update, improvement or maintenance operation.

As previously mentioned herein, VBC cannot in any case be held responsible for delays in carrying out an order for reasons beyond its control, beyond its control, unpredictable and irresistible or whose fault cannot be attributed to it attributable.

VBC is exempt from all liability when the breach or improper performance of the sales contract is due to one of the following circumstances:

- Either in a case of force majeure (external event beyond the control of VBC) unpredictable and irresistible making the execution of the obligation impossible.

Article 7: Payment of the price

Unless otherwise provided, all sales are paid in cash at the time of placing the order.

When ordering, payments are made online using the secure Paypal or Visa card payment platform.

The order validated by the Customer will not be considered effective until the payment has reached VBC.

VBC also reserves the right to refuse any order from a customer with whom there is a dispute.

Article 8: Guarantees

The Company undertakes to use all human and material resources to carry out the service within the deadlines announced when placing the Order. However, it can in no way be held responsible for delays in carrying out orders

caused by faults which are not attributable to him.

If the delivery has not been made within the prescribed time, the resolution of the sale may be requested by the Customer under the conditions provided for in articles L216-2 and L216-3 of the Consumer Code. The sums paid by the Customer will be returned to him at the latest within fourteen days following the date of termination of the contract. This provision does not apply when the delay of the Company is due to a fault of the Customer or a case of force majeure, that is to say to the occurrence of an unforeseeable, irresistible event independent of the will of the Society.

In the event that the execution of a physical service could not be carried out or was postponed due to an error on the address indicated by the Customer, the travel expenses of the service provider appointed by the Company to carry out the unsuccessful service will be charged to the Client.

Article 9: Complaints

For all Orders placed on this Site, the Customer has a right of complaint for 10 days from delivery.

To exercise this right of complaint, the Customer must send the Company, at the address valeriebcartier@gmail.com, a declaration in which he expresses his reservations and complaints, accompanied by the supporting documents relating thereto.

A complaint not respecting the conditions described above cannot be accepted.

After examining the complaint, the Site may, if necessary, replace or reimburse the order as soon as possible and at its expense.

Article 10: Intellectual property

All elements of the valeriebcartier.com site are and remain the exclusive intellectual property of VBC. Nobody is authorized to reproduce, exploit, distribute or use for any reason whatsoever, even partially, elements of the site, without having previously obtained

written permission from VBC.
